Data Protection Act (BDSG-neu), data controllers must comply with requirements for the erasure of personal data. In order to keep an overview of which personal data is processed in an organisation, every organisation should create a so-called \"erasure concept\".<\/p>\n<p>When designing the erasure concept, there are no legal requirements as to what an erasure concept should look like. It is recommended that companies and organisations follow DIN 66398, the \"Guideline for the development of an erasure concept with derivation of erasure periods for personal data\".<\/p>\n<p>In the deleted under certain conditions.<\/li>\n<li style=\"font-size: 20px;\">Specifications from the GDPR and the BDSG-neu, must be regulated in the erasure concept<\/li>\n<li style=\"font-size: 20px;\">Neither the BDSG-neu nor the GDPR regulate in detail how an erasure concept must be structured, therefore DIN 66398 has been established for the implementation of the erasure concept<\/li>\n<li style=\"font-size: 20px;\">Further legal requirements may stand in the way of erasure and must also be observed<\/li>\n<li style=\"font-size: 20px;\">Measures in connection with the Personal data may be stored for longer periods insofar as the personal data are processed solely for archiving purposes in the public interest or for scientific and historical research purposes or for statistical purposes, subject to the implementation of appropriate technical and organisational measures required by this Regulation to protect the rights and freedoms of the data subject.\"<\/p>\n<\/blockquote>\n<\/div><\/section><br \/>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-kx8w2bad-2aefdfbcc92b6daf5d557aa07523c933\">\n#top .av-special-heading.av-kx8w2bad-2aefdfbcc92b6daf5d557aa07523c933{\npadding-bottom:10px;\n}\nbody .av-special-heading.av-kx8w2bad-2aefdfbcc92b6daf5d557aa07523c933 .av-special-heading-tag .heading-char{\nfont-size:25px;\n}\n.av-special-heading.av-kx8w2bad-2aefdfbcc92b6daf5d557aa07523c933 .av-subheading{\nfont-size:15px;\n}\n<\/style>\n<div  id=\"recht-auf-vergessenwerden\"  class='av-special-heading av-kx8w2bad-2aefdfbcc92b6daf5d557aa07523c933 av-special-heading-h3 blockquote modern-quote  avia-builder-el-36  el_after_av_textblock  el_before_av_textblock'><h3 class='av-special-heading-tag'  itemprop=\"headline\"  >Right to be forgotten<\/h3><div class=\"special-heading-border\"><div class=\"special-heading-inner-border\"><\/div><\/div><\/div><br \/>\n<section  class='av_textblock_section av-kx8w31tp-6de6bc2b5015f9d168333c4e5f723adc'   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock'  itemprop=\"text\" ><p>Article 17 of the GDPR defines the grounds on which data controllers must erase personal data (Article 17(1) of the GDPR), the measures data controllers must take (Article 17(2) of the GDPR) and the exceptions in which personal data need not be erased (Article 17(3) of the GDPR).<\/p>\n<h4>Reasons for the occurrence of the erasure period (Art. 17 (1) GDPR)<\/h4>\n<ol>\n<li>The data subject shall have the right to obtain from the controller the erasure without delay of personal data concerning him or her and the controller shall be obliged to erase personal data without delay where one of the following grounds applies:<\/li>\n<li style=\"list-style-type: none;\">\n<ol style=\"list-style-type: lower-alpha;\">\n<li>The personal data are no longer necessary for the purposes for which they were collected or otherwise processed.<\/li>\n<li>The data subject revokes his or her consent on which the processing is based in accordance with\u00a0<a href=\"https:\/\/help.robin-data.io\/artikel-6-dsgvo\" rel=\" noopener\">Article 6<\/a>\u00a0paragraph 1 letter a or\u00a0<a href=\"https:\/\/help.robin-data.io\/artikel-9-dsgvo\" rel=\" noopener\">Article 9<\/a>\u00a0(2)(a) and there is no other legal basis for the processing.<\/li>\n<li>The data subject shall, in accordance with\u00a0<a href=\"https:\/\/help.robin-data.io\/artikel-21-dsgvo\" rel=\" noopener\">Article 21<\/a>\u00a0(1) and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to paragraph 1.\u00a0<a href=\"https:\/\/help.robin-data.io\/artikel-21-dsgvo\" rel=\" noopener\">Article 21<\/a>\u00a0(2) object to the processing.<\/li>\n<li>The personal data have been processed unlawfully.<\/li>\n<li>The erasure of the personal data is necessary for compliance with a legal obligation under Union or Member State law to which the controller is subject.<\/li>\n<li>The personal data have been collected in relation to information society services offered pursuant to\u00a0<a href=\"https:\/\/help.robin-data.io\/artikel-8-dsgvo\" rel=\" noopener\">Article 8<\/a>\u00a0Paragraph 1.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<h4>Measures taken by the controller 17 (2) GDPR)<\/h4>\n<ol start=\"2\">\n<li>Where the controller has made the personal data public and is obliged to erase it pursuant to paragraph 1, it shall take reasonable steps, including technical measures, having regard to the available technology and the cost of implementation, to inform data controllers which process the personal data that a data subject has requested that they erase all links to, or copies or replications of, that personal data.<\/li>\n<\/ol>\n<h4>Exceptions to the erasure period (Art. 17 (3) GDPR)<\/h4>\n<ol start=\"3\">\n<li>Paragraphs 1 and 2 shall not apply insofar as the processing is necessary to\n<ol style=\"list-style-type: lower-alpha;\">\n<li>to exercise the right to freedom of expression and information;<\/li>\n<li>for compliance with a legal obligation which requires processing under Union or Member State law to which the controller is subject or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;<\/li>\n<li>for reasons of public interest in the area of public health in accordance with\u00a0<a href=\"https:\/\/help.robin-data.io\/artikel-9-dsgvo\" rel=\" noopener\">Article 9<\/a>\u00a0paragraph 2(h) and (i); retention period and the start time from which this retention period runs. The basis of a standardised erasure concept are data types into which all data stored in the company is divided. In Robin Data you can choose from over 1000 data types. So how do you maintain an overview of the applicable legal situation? This is where the data protection officers and lawyers have done the groundwork. The start time starts either at the time of data collection or at the end of a transaction or relationship.
