In beiden Gesetzen geht es um einen besseren Schutz hinweisgebender Personen sowie um die Umsetzung der Richtlinie zum Schutz von Personen, die Verst\u00f6\u00dfe gegen das Unionsrecht melden. Das Hinweisgeberschutzgesetz verbietet jegliche Sanktionen, Repressalien und Vergeltungsma\u00dfnahmen gegen\u00fcber Hinweisgebern bzw. Whistleblowern. Seit dem 02. Juli 2023 ist das deutsche Hinweisgeberschutzgesetz in Kraft getreten. Whistleblowern.<\/p>\n<p>Mit Inkrafttreten des HinSchG m\u00fcssen Unternehmen ab 50 Mitarbeitern verpflichtend ein Meldesystem f\u00fcr rechtliche Verst\u00f6\u00dfe im Berufsalltag einrichten. Die Aufgaben und Zul\u00e4ssigkeit von Whistleblowern bzw. Hinweisgebern war bis Inkrafttreten des HinSchG am 02. Juli 2023 noch nicht rechtlich eindeutig gekl\u00e4rt. In Gerichtsprozessen wurden bislang hinweisgebende Vorf\u00e4lle nach dem R\u00fccksichtnahmegebot gem. \u00a7 241 II BGB beurteilt:<\/p>\n<blockquote>\n<p>Das Schuldverh\u00e4ltnis kann nach seinem Inhalt jeden Teil zur R\u00fccksicht auf die Rechte, Rechtsg\u00fcter und Interessen des anderen Teils verpflichten.<\/p>\n<\/blockquote>\n<p>The <strong>R\u00fccksichtnahmegebot<\/strong> schreibt Besch\u00e4ftigen vor, Verst\u00f6\u00dfe intern zu melden. Traten Hinweisgeber mit eben solchen Verst\u00f6\u00dfen an die \u00d6ffentlichkeit, kamen Gerichte oft zu der Entscheidung, dass da gegen das R\u00fccksichtnahmegebot versto\u00dfen wurde. Das Verh\u00e4ltnis zwischen dem \u00f6ffentlichen Interesse \u00fcber die Ver\u00f6ffentlichung von Verst\u00f6\u00dfen und dem unternehmerischen Interesse diese zu nicht zu ver\u00f6ffentlichen, wurde demnach eher zugunsten von Unternehmen verschoben. Hinweisgeber traten in Konflikt mit vertraglichen Verpflichtungen und mussten Repressalien f\u00fcrchten.\u00a0Die EU-Whistleblower-Richtlinie schafft rechtliche Klarheit dar\u00fcber, welches Interesse vorrangig zu sch\u00fctzten ist.
