Im Jahr 1983 fanden Haust\u00fcrbefragungen von B\u00fcrgern und B\u00fcrgerinnen \u00fcber pers\u00f6nliche Daten statt. Diese Befragung l\u00f6ste Widerstand in der Bev\u00f6lkerung aus, zumal die weiterf\u00fchrende Verwendung dieser erhobenen Daten unklar war. Daraus resultierte eine Verfassungsklage, welche vom Bundesverfassungsgericht gepr\u00fcft wurde. Am 15. Dezember 1983 wurde die Befragung als verfassungswidrig erkl\u00e4rt.<\/p>\n<p>Gr\u00fcnde daf\u00fcr waren der erhebliche und ungerechtfertigte Eingriff in die Grundrechte Einzelner, sowie die M\u00f6glichkeit mit den erhaltenen Daten Pers\u00f6nlichlichkeitsprofile zu stellen, welche eine Gefahr f\u00fcr die Pers\u00f6nlichkeit- und andere Grundrechte darstellen. Dieses Urteil legte den Grundstein f\u00fcr die Novellierung des <a href=\"https:\/\/help.robin-data.io\/bdsg\" target=\"_blank\" rel=\"noopener\">Federal Data Protection Act (BDSG)<\/a> from 1990. Dies beinhaltet auch die Entscheidung dar\u00fcber, wann und wof\u00fcr diese Daten verwendet werden d\u00fcrfen.<\/p>\n<p>Das Volksz\u00e4hlungsurteil von 1983 definiert das Recht auf informationelle Selbstbestimmung wie folgt:<\/p>\n<blockquote>\n<p>\u201eDas Grundrecht gew\u00e4hrleistet insoweit die Befugnis des Einzelnen, grunds\u00e4tzlich selbst \u00fcber die Preisgabe und Verwendung seiner pers\u00f6nlichen Daten zu bestimmen.\u201c<\/p>\n<\/blockquote>\n<p>Das Recht auf informationelle Selbstbestimmung gew\u00e4hrleistet somit einen Schutz personenbezogener Daten vor unbegrenzte Erhebung, Speicherung, Verwendung und Weitergabe von personenbezogenen Daten. Darunter fallen auch staatliche Datenerhebungen, sowie die Datenverarbeitung und Datenvermittlung durch eine \u00f6ffentliche Stelle. Zudem sch\u00fctzt das Recht personenbezogene Daten davor, zu einem vom Eigent\u00fcmer nicht zugestimmten Verwendungszweck verarbeitet zu werden. Eine wesentliche Parallele zur DSGVO, die auch in <a href=\"https:\/\/help.robin-data.io\/artikel-6-dsgvo\" target=\"_blank\" rel=\"noopener\">Article 6<\/a> is described.<\/p>\n<p>Dabei ist zu beachten, dass das Recht auf informationelle Selbstbestimmungen nicht schrankenlos besteht. Bereits im \u201e<a href=\"https:\/\/www.bundesverfassungsgericht.de\/SharedDocs\/Entscheidungen\/DE\/1983\/12\/rs19831215_1bvr020983.html\" target=\"_blank\" rel=\"noopener\">V\u00f6lkerz\u00e4hlungsurteil<\/a>\u201c wurde festgehalten:<\/p>\n<blockquote>\n<p>\u201eMit dem Recht auf informationelle Selbstbestimmung w\u00e4ren eine Gesellschaftsordnung und eine diese erm\u00f6glichende Rechtsordnung nicht vereinbar, in der B\u00fcrger nicht mehr wissen k\u00f6nnen, wer was wann und bei welcher Gelegenheit \u00fcber sie wei\u00df. Wer unsicher ist, ob abweichende Verhaltensweisen jederzeit notiert und als Information dauerhaft gespeichert, verwendet oder weitergegeben werden, wird versuchen, nicht durch solche Verhaltensweisen aufzufallen.\u201c<\/p>\n<\/blockquote>\n<p>Die informationelle Selbstbestimmung gibt es also, um eine Vereinbarkeit der Gesellschaftsordnung und Rechtsordnung zu erzielen. Die ist laut Urteil nur dann m\u00f6glich, wenn jeder Einzelne in Erfahrung bringen kann \u201ewer was wann und bei welcher Gelegenheit \u00fcber sie wei\u00df\u201c. Mit dem Volksz\u00e4hlungsurteil wurde deutlich, dass in der Bev\u00f6lkerung Bedenken dar\u00fcber existierten, dass Verhaltensweisen dokumentiert und dauerhaft gespeichert werden k\u00f6nnten. Um vor dieser Erfassung und Speicherung von Daten sowie Informationen gesch\u00fctzt zu sein, besteht die M\u00f6glichkeit, dass B\u00fcrger sich in ihrem Verhalten einschr\u00e4nken. Daraufhin erkl\u00e4rte das Bundesverfassungsgericht die \u00dcbermittlungsregelungen des damaligen Volksz\u00e4hlungsgesetzes als unvereinbar mit dem Grundgesetz.<\/p>\n<\/div><\/section><br \/>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-kqm6dmkc-6922a8fb6ba8755dd40636a6ff67dc53\">\n#top .hr.hr-invisible.av-kqm6dmkc-6922a8fb6ba8755dd40636a6ff67dc53{\nheight:30px;\n}\n<\/style>\n<div  id=\"voraussetzungen\"  class='hr av-kqm6dmkc-6922a8fb6ba8755dd40636a6ff67dc53 hr-invisible  avia-builder-el-21  el_after_av_textblock  el_before_av_textblock'><span class='hr-inner'><span class=\"hr-inner-style\"><\/span><\/span><\/div><br \/>\n<section  class='av_textblock_section av-kqm66iz6-b4caed5522c8fbc5293fa529d9e6dabf'   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock'  itemprop=\"text\" ><h2>Was ist f\u00fcr die informationelle Selbstbestimmung notwendig?<\/h2>\n<p>Um die Grunds\u00e4tze der informationellen Selbstbestimmung zu erf\u00fcllen, muss die Privatsph\u00e4re des Einzelnen gesch\u00fctzt werden. Dies basiert auf bestimmten Gesetzgebungen, die gleichzeitig eine wichtige Bedingungen f\u00fcr Demokratie und Rechtsstaatlichkeit bedeuten. Eine dieser Gesetzgebungen ist die Datenschutzgrundverordnung, die einen erweiterten Schutz von personenbezogenen Daten bewirkt und das <strong>fundamental right to informational self-determination<\/strong> st\u00e4rkt. In Zeiten von Digitalisierung, fortschreitender Datenerhebung und Vernetzung sind es aber auch die Grunds\u00e4tze der Datenminimierung, von Privacy by Default sowie Privacy by Design, welche bei der technischen Ausrichtung und Erfassung von Daten immer notwendiger werden, um den Anforderungen der informationellen Selbstbestimmung gerecht zu werden.<\/p>\n<\/div><\/section><br \/>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-kqm6dbtg-5c442f1321a92cc5f0b60ffd3898c6cd\">\n#top .hr.hr-invisible.av-kqm6dbtg-5c442f1321a92cc5f0b60ffd3898c6cd{\nheight:30px;\n}\n<\/style>\n<div  id=\"geltungsbereich\"  class='hr av-kqm6dbtg-5c442f1321a92cc5f0b60ffd3898c6cd hr-invisible  avia-builder-el-23  el_after_av_textblock  el_before_av_textblock'><span class='hr-inner'><span class=\"hr-inner-style\"><\/span><\/span><\/div><br \/>\n<section  class='av_textblock_section av-kqm6cgn9-4f2f9629badd43d148aaeb8144a2bdea'   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock'  itemprop=\"text\" ><h2>Wann und f\u00fcr wen gilt das Recht auf informationelle Selbstbestimmung?<\/h2>\n<p>Soweit keine Rechte anderer verletzt werden, beziehungsweise kein Versto\u00df gegen die verfassungsm\u00e4\u00dfige Ordnung oder Sittengesetzte vorliegt, gilt das Recht auf informationelle Selbstbestimmung uneingeschr\u00e4nkt f\u00fcr jeden. Eine Ausnahme gibt es dennoch, denn die informationelle Selbstbestimmung l\u00e4sst sich rechtlich einschr\u00e4nken. Dies kann bspw. ein allgemeiner Gesetzesvorbehalt sein, welcher das Grundrecht einschr\u00e4nkt. Aber auch formelle und materielle verfassungsgem\u00e4\u00dfe Gesetze sind zur Rechtfertigung in der Lage.<\/p>\n<\/div><\/section><br \/>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-kqm6d2al-c01f3bfb383c7b9294b97f52877e484c\">\n#top .hr.hr-invisible.av-kqm6d2al-c01f3bfb383c7b9294b97f52877e484c{\nheight:30px;\n}\n<\/style>\n<div  id=\"bedeutung-unternehmen\"  class='hr av-kqm6d2al-c01f3bfb383c7b9294b97f52877e484c hr-invisible  avia-builder-el-25  el_after_av_textblock  el_before_av_textblock'><span class='hr-inner'><span class=\"hr-inner-style\"><\/span><\/span><\/div><br \/>\n<section  id=\"bedeutung-unternehmen\"  class='av_textblock_section av-kqm6cuj1-25952804834a79f3059ca8282cb88df8'   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock'  itemprop=\"text\" ><h2>Bedeutung f\u00fcr Unternehmen<\/h2>\n<p>Mit Inkrafttreten der DSGVO m\u00fcssen die Grunds\u00e4tze des Rechts auf informationelle Selbstbestimmung auch von Unternehmen gewahrt werden. Betroffen sind davon alle Unternehmen in der EU, sowie Unternehmen, welche Daten von europ\u00e4ischen B\u00fcrgern verarbeiten.<\/p>\n<p>Die Grunds\u00e4tze f\u00fcr die Verarbeitung personenbezogener Daten sind in <a href=\"https:\/\/help.robin-data.io\/artikel-5-dsgvo\" target=\"_blank\" rel=\"noopener\">Article 5 of the GDPR<\/a> defined:<\/p>\n<ul>\n<li><strong>a) Rechtm\u00e4\u00dfigkeit<\/strong> \u2013 Verarbeitung nach Treu und Glauben, Transparenz<\/li>\n<li><strong>(b) Earmarking<\/strong> \u2013 personenbezogene Daten d\u00fcrfen nur zu festgelegten, eindeutigen und legitimen Zwecken erhoben werden<\/li>\n<li><strong>(c) data minimisation<\/strong> \u2013 erhobene Daten d\u00fcrfen nur in notwendiger Weise erhoben werden<\/li>\n<li><strong>(d) Accuracy<\/strong> \u2013 personenbezogene Daten m\u00fcssen sachlich richtig und auf dem aktuellen Stand sein. Daten, welche Abweisungen aufweisen m\u00fcssen unverz\u00fcglich gel\u00f6scht oder berichtig werden<\/li>\n<li><strong>e) Memory limitation<\/strong> \u2013 erhobene Daten d\u00fcrfen nur so lange gespeichert werden, wie es f\u00fcr Zweck der Erhebung erforderlich ist<\/li>\n<li>f<strong>) Integrit\u00e4t und Vertraulichkeit<\/strong> \u2013 Daten m\u00fcssen so verarbeitet werden, dass ein angemessener Schutz durch TOMs<\/li>\n<\/ul>\n<p>Kommen Verantwortliche diesen Pflichten nicht nach oder verf\u00fcgen sie \u00fcber keinen entsprechenden Nachweis, verletzen Sie die Rechenschaftspflicht <a href=\"https:\/\/help.robin-data.io\/artikel-5-dsgvo\" target=\"_blank\" rel=\"noopener\">gem\u00e4\u00df Art. 5 Abs. 2 DSGVO.<\/a><\/p>\n<p>Neben diesen Grunds\u00e4tzen stellt die DSGVO noch weitere Anforderungen. Darunter f\u00e4llt das Prinzip des Verbots mir Erlaubnisvorbehalt, welches vorsieht, dass ein grunds\u00e4tzlich bestehendes Verbot zur Verarbeitung personenbezogener Daten durch eine Erlaubnis in Form einer Rechtgrundlage aufgehoben wird.<\/p>\n<p>Zu beachten ist zudem die Rechtm\u00e4\u00dfigkeit der Verarbeitung, die in <a href=\"https:\/\/help.robin-data.io\/artikel-6-dsgvo\" target=\"_blank\" rel=\"noopener\">Article 6 of the GDPR<\/a> beschrieben wird, sowie die Verarbeitung besonderer Kategorien personenbezogener Daten gem\u00e4\u00df<a href=\"https:\/\/help.robin-data.io\/artikel-9-dsgvo\" target=\"_blank\" rel=\"noopener\"> Article 9 GDPR<\/a>. In beiden F\u00e4llen liegt eine rechtm\u00e4\u00dfige Verarbeitung vor, wenn der Betroffene seine Einwilligung zur Verarbeitung seiner Daten gibt.<\/p>\n<p>Dabei m\u00fcssen Unternehmen ihrer <a href=\"https:\/\/www.robin-data.io\/en\/data-protection-and-data-security-academy\/wiki\/information-obligations-gdpr\">Informationspflicht gem\u00e4\u00df Artikel 12 DSGVO<\/a> and to inform the parties concerned of the measures taken to comply with them. <a href=\"https:\/\/www.robin-data.io\/en\/data-protection-and-data-security-academy\/wiki\/technical-organisational-measures-gdpr-compliant-implementation\">technisch-organisatorischen Ma\u00dfnahmen <\/a>informieren. Betroffene m\u00fcssen dabei gleich zu Beginn \u00fcber die Erhebung und Verarbeitung ihrer personenbezogenen Daten informiert werden.
